Importance Of Employment Contracts – Know Their Value

Anyone who works for an employer for a regular wage or salary automatically has a contract of employment, regardless of whether it is written or not. The majority of employees work under open-ended contracts of employment. In other words, the contract continues until such time as the employer or employee ends it.

Many other employees however, work under fixed-term or specified-purpose contracts which are contracts which end on a specified date or when a specific task is completed.
The contract of employment will include some or all of the following elements (regardless of whether the employer and employee have specified them or not):

The terms that the courts say are in every contract of employment. Examples include the duty of every employer to provide a safe workplace and the duty of every employee to carry out the job to the best of his/her ability. This part of the contract is occasionally referred to as "common law".

Terms that must be part of the contract as a result of laws passed. Examples include the right to take maternity leave. Such terms are part of the contract of employment even if the employer and employee do not specifically include them and replace any agreement between the employer and employee not to apply the particular law. So, the statutory right to take maternity leave overrides any agreement between the employer and employee that the employee will not take maternity leave.

Terms and conditions states must be in every contract, for example, the right of an employee to join a trade union.

In addition, custom and practice in a particular workplace may form part of a contract. An example would be a particular level of overtime pay for employees.

In the case of these items instead of giving each employee the details in writing, the employer may refer an employee to other documents, for example, a pension scheme booklet or a collective agreement, provided that the employee has easy access to such documents.

The statement of terms must indicate the reference period being used by the employer for the purposes of the calculation of the employee's entitlements under the Minimum Wage Act, 2000. (Under that Act the employer may calculate the employee's minimum wage entitlement over a reference period that is no less than one week and no greater than one month).

The statement of terms must also inform the employee that he/she has the right to ask the employer for a written statement of his/her average hourly rate of pay for any reference period (except the current reference period) in the 12 months prior to the date of the employee's request.

Note. Specific provisions in contract of employment
In recent times, some employers are adding in specific provisions in contract of employment that limit the ability of employees to work in a certain sector, with certain suppliers, clients, for a period following termination of employment. (For example, it may specifically state that the employee cannot work in a certain sector, with or for suppliers or clients of the former employer, etc.). There is nothing in employment law in that strictly forbids this, but there is no provision in employment law that allows this either.

Essentially, this is an issue of contract law - that is, the contract of employment signed and agreed between the employer and employee. If you have any concerns about this issue, you are strongly advised to seek legal advice from a competent legal professional in advance of signing this contract of employment. However, even if the contract of employment is signed, you are always free to seek such legal advice. Attorney fees can vary widely so shop around and obtain some quotes for legal advice before you proceed.

Note. Probationary period
The contract can include a probationary period and can allow for this period to be extended. The Unfair Dismissals Acts will not apply to the dismissal of an employee during a period at the beginning of employment when he/she is on probation or undergoing training provided that:

* the contract of employment is in writing
* the duration of probation or training is one year or less and is specified in the contract.

The above exclusion from the Acts will not apply if the dismissal results from trade union membership or activity, pregnancy related matters, or entitlements under the maternity protection, parental leave, adoptive leave and career's leave legislation.

Changes to your contract of employment.

Changes to your contract of employment can occur due to a change in the law, but otherwise, changes must be agreed between your employer and yourself. The requirement for both the employer's and the employee's consent to changes in the terms of the contract is part of contract law.

From the above information you will see that the contract of employment is a very important document to have. Whenever you get hired, ensure that your new employer offers you this kind of security. Be cautious of employers who don't give contract of employment.

It really does amaze me the number of businesses who advertise purely for the sake of advertising. If you were to randomly ask ten business owners why they advertise, nine out of the ten will most likely say, because everyone else does or something similar.

This may seem like a strange thing to do but it is a serious challenge that is rarely addressed, especially by the smaller business owners. The real question that needs to be answered is; are you potentially tipping vast amounts of your hard earned profits down the drain because of ineffective advertising campaigns?

The best kept secret in the world of advertising is that most business advertising does not work. However, don't expect anyone who sells ad space to tell you that. Because most businesses don't monitor how well or badly any particular advertising campaign is doing, very few are aware of this fact.

Just because you have advertising budget doesn't mean you have to spend it without knowing what return you are getting. There are a multitude of sins committed when it comes to publicity but here are three key elements that you absolutely must get right every time if you are to avoid profit depletion.

1. Always Test and Measure.

It is paramount that you test and measure any advertising. This applies to all forms of promotion, TV, radio, newspaper, magazine and any other medium you use. It would seem like an obvious thing to do but very few businesses actually do it. A focused plan has to be in place so that you know, with absolute certainty that the ad you are running is worthwhile and producing a return on investment. If it is not stop it! Again this would seem obvious and logical but it doesn't always happen. Some companies will run ads for weeks and months, spending thousands of pounds or dollars with absolutely no idea if the ad is producing a profitable outcome.

2. The Headline.

Your headline is the most important part of any ad. If the headline does not catch the readers attention, your ad will not get read, period. I see ads all the time, where the headline is the company name and logo. The truth is nobody cares about your company name or if you've been established for 125 years. The headline must always appeal to your targeted audience and where possible include a benefit. Which headline is more likely to attract your attention?

The moral of the story is, take care with headlines. They can make or break your return on investment. Getting your headline right can increase your response rate by as much as 50% to 100%.

3. Printed Ads. Rule #1 Never advertise on a left hand page.

Now, some say that this little gem is all psychobabble and nonsense. Ask any of the worlds greatest marketers though and they will agree on this point. Test it for yourself! Next time you see someone flicking through a newspaper or magazine, watch their eye movement. It will almost always be orientated towards the right hand page. It really can make a huge difference in creating a successful campaign and has been proven time and time again.

It's not always easy but you have to be strong on this point. Some publications might say they can't guarantee this. Just tell them that you may advertise with them when they can and more often than not they will oblige.

If you can get these 3 elements in place then your advertising campaigns will be more successful than the majority of your competition. Obviously there are other ground rules that make up a successful campaign and a little research will go a long way. But having read this article and honestly implementing these points, you will already be streets ahead of the pack.

Well you have finally done it. You have packed in the rubbish job and told your boss exactly what you think. You have taken the plunge and made the decision to begin your own home business affiliate marketing. Home business affiliate marketing can be very lucrative. It provides people with the opportunity to work for themselves with very little risk to them. Those that are sales savvy, good at marketing and are not afraid of a little hard work can often do incredibly well with a home business affiliate marketing program.


Home business affiliate marketing sounds easy but you do need to exercise some caution. You want to avoid the home business affiliate marketing pitfalls that can ruin your home business and worse, have you crawling on your hands and knees back to that boss that now knows how you truly feel.


People tend to get excited when they start a new venture. Unfortunately this excitement and eagerness can cause them to miss key things in their agreement. Whenever you sign up for a home business affiliate marketing program, you will be expected to sign an agreement. The terms and conditions of the agreement for both sides should be outlined. However, if they want to hide something this is where they will put it. It will either be in the small print, so get your magnifying glass out, or they will baffle you with legal language. Either way, you need to read and understand your agreement thoroughly to avoid disappointment and lost earnings.


If you are signing up for a commission based home business affiliate marketing program then you need to understand how the term revenue is defined. This is one of the biggest pitfalls of the contracts. They may advertise 5-10% commissions but it all fall on how they define revenue. Most home business affiliate marketing programs will calculate commission on the gross value of the sale. In other words, the amount of money the site will get at the completion of the sale. You may think that this sounds great. However, you need to read this part of the agreement very carfully. The amount of the sale almost always excludes credit card or debit card payment surcharges. They also are likely to exclude payment and delivery charges as well as any gift wrapping or other surcharges. What sounded like a nice commission is soon shrinking before your eyes. Ask these questions specifically before you sign an agreement.


Some home business affiliate marketing programs are even stricter in their definition of revenue. Your commission may be based on the profit margin of the sold product. For example, if you help sell a book for 20 dollars but the company only makes 10 dollars profit, you will receive a percentage of 10 dollars not 20. This can make a substantial difference in your earnings. Again, make sure you understand these things and ask specifically what your commission will be based upon. Read your agreement and look out for odd sounding clauses. These could come back to haunt you later.


Something else to beware of when you work on commission is returns. Many home business affiliate marketing companies only pay commission out on completed sales and then only if the customer keeps the item. If they return the items your commission could be cancelled. To really rub salt in the wounds, you could be billed for the outstanding commission if you do not have sufficient commission credit built up. Make sure you understand this before signing on. You cannot expect a company to pay you a commission on an item that is returned but make sure you understand their return policy. Find out your rights in this situation.


Home business affiliate marketing can be a great way to earn money. If you have good sales and marketing skills then it can give you the opportunity to out them to good use. You will be able to work for yourself and not someone who undervalues and does not appreciate them. One needs to consider home business affiliate marketing carefully.
